Judge agrees Ottawa blogger was defamed, but it was 'fair comment'

A Superior Court judge has ruled that although Ottawa blogger Dr. Dawg was defamed on a conservative message board, the hurtful words fell within the bounds of fair comment in the rough and tumble blogosphere.

    I didn't even know there was a Conservative message board in Canada.

    So I tripped on over there to check it out, and Oh Oh...

    They might might have beat Dr Dawg and his Prog Blog, but he wasn't the only problem.

    We all know who Richard Warman is right? The guy who was responsible for almost all those human rights claims?

    So I don't know, but it looks like they took away his section 13 toy, but now he's just suing, or something. I forget for what.

    Anyway no more Free Dominion.

    And "Rats", cause I'd just found it.

    I think that's all correct anyway. I'm going by memory of what I read there last night. I just tried to check it out again, but the connection was dead. Wonder what was in there that was so horrible. There was just a notice explaining things last night, and few threads complaining about their windmill tilt for free speech in Canada.

    I think he has 3 different defamation suits and a copyright violation suit against Free Dominion.

    Anyway no more Free Dominion.

    Probably just a server problem - it sometimes happens to forums. :)
    I believe that only regular members can get in to the actual forum - at least until (some of) the legal problems are settled.

    Today, Ontario Superior Court Justice Robert Smith issued an order in the Richard Warman vs Mark and Connie Fournier and John Does defamation case heard September, 2013. In addition to ordering that we must pay Warman $127,000, Justice Smith issued an injunction against us ordering we that never publish, or allow to be published, anything negative about Richard Warman. This means we are barred for life from ever operating a public forum or a blog (even about cookie recipes) where the public can comment. If we do so, any one of Warman�s handful of supporters could, and probably would, use a common proxy server to avoid being traced, plant a negative comment about Warman on our site, and we would both be charged with contempt of court. If that happened --unlike in the Ottawa courtroom where we were blocked at every turn from presenting a defense-- we actually would have no defense. We would both go to jail. This life sentence was imposed for our terrible crimes of voicing our honestly held beliefs and allowing others to do the same. Defamation law, in its current state, is entirely inadequate and counterproductive when applied to the internet. Now it is being used as a tool of censorship. Effectively!

    We are assessing our options.
